FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated April 10, 2006, executed and delivered by Cynthia A. Leasure and Frank E. Leasure (“Mortgagors”) to The Jackson State Bank & Trust, and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagors, to said Mortgagee, and which Mortgage was recorded on April 17, 2006, at Reception No. 318295, in Book 134, at Page 155 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Sublette County, State of Wyoming; and

WHEREAS, the Mortgage was assigned for value as follows:

Assignee: Wilmington Savings Fund Society, FSB, D/B/A Christiana Trust, not individually but as Trustee for Pretium Mortgage Acquisition Trust

Assignment dated: August 4, 2017

All in the records of the County Clerk and ex-officio Register of Deeds in and for Sublette County, Wyoming.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of May 30, 2019 being the total sum of $287,575.47, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

WHEREAS, if the foreclosure sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of his/her/its money paid.  The Purchaser shall have no further recourse against the Mortgagee, Mortgagor, Servicer or their attorneys;

NOW, THEREFORE Wilmington Savings Fund Society, FSB, D/B/A Christiana Trust, not individually but as Trustee for Pretium Mortgage Acquisition Trust, as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Sublette County, Wyoming to the highest bidder for cash at 10:00 o’clock in the forenoon on June 28, 2019 on the Courthouse steps for the Sublette County Court located at 21 South Tyler Ave., Pinedale, WY , for application on the above described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

Lot 8 of the Amended Plat of the Giebel Subdivision, Sublette County, Wyoming. 

With an address of 16 Trapper Lane, AKA 16 Trappers Lane, Pinedale, WY 82941 (the undersigned disclaims liability for any error in the address).

Together with all improvements thereon situate and all fixtures and appurtenances thereto.

Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.

PUBLIC NOTICE

NOTICE OF FINAL COMPLETION

OF CONTRACT

To all persons, firms, or corporations who have any claim for any work being done, or any material furnished to, RS Bennett Construction Company, Inc., 601 N Highway 189, Big Piney, WY 83113 for the BIG PINEY PATHWAY CD#17305, Big Piney, Wyoming.

You are hereby notified that the Town of Big Piney, Wyoming has accepted final completion according to the Contract Documents and rules set forth in the contract between the Town of Big Piney and the aforesaid Contractor of the work in connection with the BIG PINEY PATHWAY CD#17305, and that said Contractor is entitled to final settlement thereof.

You are further notified that upon the fifteenth day of July, 2019, being the 41st day after the first publication of the notice, said Town of Big Piney will pay RS Bennett Construction Company, Inc. the full amount due under said contract; and in the event your claim is not filed with the Town of Big Piney prior to said fifteenth day of July, 2019, same shall be waived.

This notice is given pursuant to Section 16-6-116, Wyoming Statutes, 1982.

Frank Grimes, Jack Roberts, and John Walter, the duly elected, qualified and acting Commissioners of Highland Irrigation District, P O Box 567, Pinedale, WY 82941 having filed their report pursuant to the requirements of Section 41-7-402, Wyoming Statutes, 1977, showing that each landowner in the District should be assessed a minimum of $25.00 per parcel for the current expenses and a further assessment of $3.00 per acre upon the benefited lands of the District for the purpose of raising funds for current expenses and costs of new work and maintenance of said District, in the fiscal year beginning July 1, 2019;
